Driving under the influence (DUI)
We represent folks charged with a DUI (driving under the influence) including first, second, and subsequent offenses. We challenge the validity of any chemical tests and the authority of the police to have stopped you in the first place. Some first-time offenders may be eligible for an Accelerated Rehabilitative Disposition (ARD) program which helps keep you out of jail and provides that your criminal record may be eligible for expungement if you complete the terms of the court-ordered programs and conditions.
We also represent employees who are denied employment, denied advancement, or terminated because of their race, religion, country of origin, gender, disability, age (40 and older), and other protected identities. At Carmody and Ging, we also represent employees when employers retaliate because you asserted a legal right, filed a whistleblower complaint, or experienced sexual harassment in the workplace. Our lawyers also advise clients about family leave rights, trade provisions, severance packages, and other employee rights.
Estate planning and administration
We advise seniors, parents, and all adults about their estate planning requirements. We review your goals, asset and debt status, how your property is titled, and other factors. Based on the review, we prepare wills, trusts, powers of attorney, and other estate planning documents and documents to plan for physical and mental challenges in your advanced years. We help you prepare documents that help to address conflicts when you die and reduce your inheritance and estate taxes.
Our Pittsburgh estate lawyers also represent executors and personal representatives when a loved one has died. We submit the will for probate, prepare inventories and accountings, and advise clients how to acquire, manage, and distribute the estate.
Business, real estate, and zoning issues
Carmody and Ging advises business-on-business contract litigation and a range of other business issues. Some of our successful results include a six-figure award against a general contractor for not paying a subcontractor on a large construction project, a six-figure verdict against a contractor who performed sub-standard construction on a residential home remodeling job, and the negotiation and settlement of complex multi-million dollar dispute on a large construction project. We also defended a prominent businessman in a lawsuit claiming a six-figure damage amount for breaching a contract.
We also represent homeowners and businesses who need zoning approval for residential, commercial, and industrial needs. Common zoning issues include requests for variances – permission to use, modify, or expand property for new purposes. Two successful zoning cases we handled include successfully opposing an attempt by a developer to place storage facilities in a residential area and successfully opposing an attempt by a developer to place sub-standard apartment buildings in a residential area.
Referrals and serving as local counsel
Our attorneys also accept referrals from other lawyers.
We are ready to serve as local counsel for lawyers whose practice is based outside of Pittsburgh – another Pennsylvania county, another state, or even another country.
