Our Pittsburgh Uber and Lyft accident lawyers are skilled at showing why rideshare accidents happen and who is responsible. Many Uber and Lyft accidents happen because the driver is focused on the next ride and not the current ride. Common cause of rideshare accident include:

  • Driving while intoxicated
  • Driving while distracted
  • Driving while fatigued
  • Speeding and other traffic violations
  • Driving too fast for traffic conditions

Who may be liable for a Pittsburgh Uber or Lyft accident?

In Pennsylvania, we file claims against all responsible defendants. The defendants may include the Uber or Lyft driver, another driver, a manufacturer of defective car parts, and other defendants such as the Pennsylvania Department of Transportation.

What is the value of my Pittsburgh rideshare accident?

Uber and Lyft vehicles are commercial vehicles so passengers in an Uber vehicle and pedestrians can generally file a claim for all their damages.

Damages in an Uber or Lyft accident case include all your current and future:

  • Medical bills
  • Lost income including a permanent disability
  • Pain and suffering
  • Scarring and disfigurement
  • Loss of consortium

The complicated issue is how insurance works in your claim. Pennsylvania provides that Uber and Lyft carriers are classified as transportation network companies. Pennsylvania law requires that the drivers for transportation network companies such as Uber and Lyft have the following insurance coverage.

  • If the driver is not engaged in a prearranged ride, the driver must have:
    • Bodily injury and death coverage per person. $50,000.
    • Bodily injury and death coverage per accident. $100,000.
    • Property damage. $25,000.
    • First party benefits. This insurance should cover passengers and pedestrians.
  • The driver is engaged in a prearranged ride, the driver must have:
    •  Bodily injury, death coverage, and property damage. Total coverage of $500,000.
    • First party benefits. This insurance should cover the driver (up to $5,000) and
      pedestrians (up to $25,000).

However, Uber and Lyft also provide coverage for when their drivers are on the clock, en route to picking up a fare, or driving with a paying passenger.

If the driver is on the clock but does not have a passenger, both companies provide:

1. Up to $50,000 in bodily injury coverage per person
2. Up to $100,000 in bodily injury coverage per accidents
3. Up to $25,000 in property damage

If the driver is on their way to getting a fare or is already transporting someone in the vehicle, both Uber and Lyft provide up to $1,000,000 in coverage for bodily injury, property damage, and UM/UIM coverage.

Either the driver or the transportation network company (Uber or Lyft) must provide the full coverage. A combination of policies may also suffice. Uber and Lyft have a duty to ensure that their driver has the proper insurance before the driver accepts any rides.
